General conditions of sale
Article 1 - This contract of seasonal rental is reserved for the exclusive use of the lodgings proposed by APAKABAR HOMESTAY (furnished of tourism 3* and rooms of hosts).
Article 2 - Duration of the stay: The signatory tenant of the present contract concluded for a determined duration will not be able under any circumstances to prevail himself of an unspecified right to maintain in the places at the end of the stay.
Article 3 - conclusion of the contract : The reservation becomes effective as soon as it is confirmed by telephone or on the Apakabar Homestay website or by an online reservation platform.
For the lodging, a rental contract will have to be signed at the arrival of the tenant on the premises.
The rental agreement concluded between the parties to this contract may not in any case benefit even partially to third parties, natural or legal persons, except with the written agreement of the owner.
Any infringement of this last paragraph would be likely to involve the immediate cancellation of the hiring with the wrongs of the tenant.
Article 4 - Cancellation by the tenant : Any cancellation must be notified by registered letter to the owner.
a) cancellation before the arrival in the premises. If the tenant does not show up within 24 hours after the arrival date indicated on the contract, the present contract becomes null and void and the owner can dispose of his gite. The deposit also remains with the owner who will ask for the payment of the balance of the rent.b) if the stay is shortened, the price of the rental remains with the owner. There will be no refund.Article 5 - cancellation by the owner : The owner will pay the tenant the totality of the paid sums.
Article 6 - inventory of fixtures: An inventory is established in common and signed by the tenant and the owner or his representative at the arrival and the departure of the lodging. This inventory is the only reference in case of dispute concerning the state of the premises.
The state of cleanliness of the gite on the arrival of the tenant must be noted in the inventory. The cleaning of the premises is the responsibility of the tenant during the rental period and before his departure.
Article 7 - Deposit : On the arrival of the tenant, a deposit equivalent to the first night is requested by the owner for stays of one week and more. After the contradictory establishment of the inventory of fixtures of exit, this deposit is restored, deduction made of the cost of restoration of the places if degradations were noted.
In case of early departure (before the time mentioned on the present contract) preventing the establishment of the inventory of fixtures on the day of the tenant's departure, the deposit is returned by the owner within a period not exceeding one week.
Article 8 - capacity : The present contract is established for a maximum capacity of 8 persons. If the number of tenants exceeds the capacity of reception, the owner can refuse the additional persons. Any modification or breach of contract will be considered at the initiative of the client.
Article 9 - reception of the animals: The tenant can stay in company of a domestic animal for a supplement of 10€ per night and per animal.
Article 10 - insurance : The tenant is responsible for all damages occurring by his own doing. He is required to be insured by an insurance contract for these different risks.
Article 11 - payment of the loads: the totality of the loads is included in the selling price.
Article 12 - disputes: Any complaint relating to the state of the premises and/or the state of the description of the place of stay, must be submitted to the reservation service within 3 days of entering the premises. Any other complaint must be sent to the reservation service as soon as possible, by letter. One month later, if you are not satisfied, you can contact the MEDICYS mediation service simply and free of charge by submitting your file on or by simple mail (attach your email, telephone number and the written complaint) to MEDICYS - 73, Boulevard de Clichy - 75009 Paris.When the reservation service, as an agent, has to pay the client on behalf of the owner, the latter subrogates it in the rights and actions it holds against the owner.
